All items are sold “as-is, where-is” without warranties, guarantees, or representations of any kind. Buyers are responsible for reviewing available descriptions and inspecting items before purchase.

  • By using this website or attending an estate sale hosted by Once Upon A Find Estate Sales, you acknowledge that you enter and participate at your own risk. To the extent permitted by applicable law, Once Upon A Find Estate Sales, its owners, employees, contractors, and staff are not responsible for accidents, injuries, theft, damage, or loss of personal property.

  • For items that are shipped, risk of loss or damage transfers to the buyer once the item has been delivered to the shipping carrier. Buyers are responsible for purchasing any desired shipping insurance and for filing applicable loss or damage claims directly with the carrier.

  • Information provided on this website is for general informational purposes only and should not be considered legal, financial, tax, appraisal, or other professional advice.

  • 1. Use of Website

  • This website may be used to learn about our services, view upcoming and current estate sales, contact our business, and purchase available items when applicable.

  • Fraudulent activity, unauthorized use, interference with the website, or misuse of its content is prohibited.

  • 2. Estate Sale Services & Payments

  • Estate sale bookings and services are subject to availability and acceptance by Once Upon A Find Estate Sales.

  • Accepted payment methods at estate sales include Cash, Zelle, and Cash App. No checks are accepted.

  • We reserve the right to modify our services, policies, sale dates, sale hours, or other business practices when reasonably necessary.

  • 3. Item Condition & Final Sales

  • All merchandise is sold “as-is, where-is.” We make no warranties or guarantees regarding the condition, age, authenticity, functionality, completeness, or fitness for a particular purpose of any item unless expressly stated in writing.

  • Buyers are responsible for inspecting merchandise before purchasing it.

  • All sales are final. No refunds, returns, or exchanges.

  • 4. Removal of Purchased Items

  • Buyers are responsible for safely removing and transporting purchased merchandise unless other arrangements have been expressly agreed upon.

  • Customers should bring appropriate assistance, vehicles, equipment, and packing materials necessary to remove their purchases.

  • 5. Shipping

  • When shipping is offered, risk of loss or damage transfers to the buyer once the item has been delivered to the shipping carrier.

  • Buyers are responsible for purchasing any desired shipping insurance and filing applicable claims with the shipping carrier for lost or damaged shipments.

  • 6. Estate Sale Rules

  • Anyone attending an estate sale must comply with the posted Estate Sale Rules, instructions from staff, and reasonable rules established for the safety and protection of customers, employees, the property, and merchandise.

  • 7. Right to Refuse Service

  • Once Upon A Find Estate Sales reserves the right to refuse service or require an individual to leave a sale for violating our rules, threatening or abusive conduct, suspected theft or fraud, unsafe behavior, or other lawful reasons.

  • 8. Property & Personal Safety

  • Customers enter estate sale properties and participate in estate sales at their own risk.

  • To the extent permitted by applicable law, Once Upon A Find Estate Sales, its owners, employees, contractors, staff, and the property owner are not responsible for accidents, injuries, theft, damage, or loss of personal property occurring while attending an estate sale.

  • 9. Intellectual Property

  • Unless otherwise indicated, original website content, branding, logos, graphics, photographs, and written materials belonging to Once Upon A Find Estate Sales may not be reproduced, distributed, or commercially used without authorization.

  • 10. Changes to These Terms

  • Once Upon A Find Estate Sales may update these Terms & Conditions periodically. Updated terms become effective when published on this website unless otherwise stated.

Refund Policy

All sales are final. Items are sold “as-is, where-is” with no refunds, returns, or exchanges. Once Upon A Find Estate Sales makes reasonable efforts to provide accurate descriptions and photographs; however, buyers are responsible for reviewing available information and inspecting items when possible before purchasing. For shipped orders, risk of loss or damage transfers to the buyer once the item is delivered to the carrier. Buyers are responsible for purchasing any desired shipping insurance and filing applicable claims directly with the carrier for lost, delayed, or damaged shipments.

Estate Sale Rules

For the safety of our customers, staff, and properties, all visitors must follow the rules of Once Upon A Find Estate Sales. All sales are final, and merchandise is sold “as-is, where-is.” No early entry is permitted, and entry may be limited when necessary. Children must remain supervised by an adult, and no large bags, backpacks, food, drinks, or pets are permitted inside unless otherwise authorized or required by applicable law. Please handle merchandise carefully, follow all posted parking instructions, and do not block neighboring driveways or properties. Buyers are responsible for safely removing and transporting their purchases. Once Upon A Find Estate Sales reserves the right to refuse service or require an individual to leave for unsafe, disruptive, fraudulent, threatening, or unlawful conduct or failure to follow sale rules.

One change I'd make from the old site: don't use an absolute statement saying customers “release” the company from any liability. A website disclaimer doesn't automatically eliminate every type of liability. Your new wording should say things such as “to the extent permitted by applicable law” where you're trying to limit liability.
